Final Determination

Twelve days after the NCHRC issued the final determination on the investigation, I finally received it in the mail. They hadn’t updated my mailing address, despite me providing it, which caused the delay. You’ll notice the determination was issued five days after I emailed HUD—stating there were no reasonable grounds for my claim. After reviewing the report they sent, it became clear why: they didn’t include any of the evidence I had submitted.

I also received a letter from HUD dated February 7, 2025—again mailed to the wrong address. The letter falsely claimed that the North Carolina Human Relations Commission had processed my complaint “in a timely manner” and that HUD could not intervene unless the agency waived jurisdiction. But here’s the issue: that statement ignores the fact that the NCHRC is not just a certified Substantially Equivalent Agency (SEA); it is a federally funded FHAP agency. The documents show the NCHRC processed my case as a FHAP agency, which carries stricter oversight requirements under federal law. HUD’s mischaracterization allowed them to improperly dismiss my appeal and avoid accountability, despite clear evidence of noncompliance.

Because of what happened, I emailed the Chief Judge at the Office of Administrative Hearings and requested an investigation into how this was handled. I made it very clear that I intended to appeal the determination through HUD—and I did. I mailed my appeal to HUD’s Fair Housing Enforcement Office, as required. Despite calling multiple times to confirm that the Chief Judge received my email and to check the status of my request. I explained that I was trying to avoid having to file a formal petition, as I wasn’t sure if this was a systemic issue with the NCHRC or the result of misconduct by the director and investigator specifically.
